In the context of a divorce action, in September 2012 the firm settled a claim on behalf of a client whose husband, a physician, had failed to disclose to her that he was infected with the herpes virus, with the result that she became infected with the virus, which is incurable. The firm argued that not only did the husband have a duty to make such a disclosure to his spouse before and during marriage, but also that this duty was heightened by the fact that he was a physician and presumably knowledgeable about the transmission of the herpes virus.
