John Ingrassia was able to successfully have DWI charges dismissed after successfully moving to suppress evidence following and illegal stop of his client’s motor vehicle.

Mr. Ingrassia was able to establish that the police officer did not have probable cause to believe that his client had tinted windows in excess of the state’s legal limit. He was able to produce evidence from a motor vehicle repair shop that demonstrated the tint was legal.

Mr. Ingrassia also was able to persuade the Judge to reject the prosecution’s argument that the stop was lawful given the police officer’s mistake of law. Contrary to their arguments Mr. Ingrassia’s cross examination of the arresting police officer established that he was unaware of certain aspects of the law with regards to excessive tint on windows so, therefore, his mistake of law could not be objectively reasonable given his experience as a police officer.

As a result, the Court suppressed all evidence obtained because of the unlawful stop including the chemical test results and all observations of the accused. Thereafter, all charges were dismissed by the prosecution.
