When Being High in Public Could Lead to Legal Trouble
While New York does not criminalize simply being under the influence of marijuana in a public space, there are related behaviors that can result in charges. The most serious is driving while impaired.
Under Vehicle and Traffic Law § 1192, operating a motor vehicle while impaired by cannabis carries the same weight as a DUI involving alcohol. Unlike alcohol, New York does not set a specific THC threshold. Instead, law enforcement evaluates impairment based on observed behavior and other evidence. Penalties for a conviction can include fines, license suspension, and jail time, depending on the facts and circumstances of the case.
Other situations where being high in public could create legal issues include disorderly conduct cases and possession of amounts exceeding the legal limit. The latter case can lead to both civil penalties and criminal charges based on the quantity in question.
