A Wappingers Falls nurse at St. Francis Hospital in Poughkeepsie obtained a $1.75 million settlement Nov. 21 in her suit over being attacked by an outpatient. In Maurer v. Anderson School, 1998-4597, plaintiff Lynette Maurer suffered a brain injury and memory loss after a developmentally disabled student attacked her at the hospital. Three employees of the Anderson School, a school in Staatsburg for the disabled, had taken the youth to the hospital after he was involved in a fight earlier in the day. Elliot S. Tetenbaum of the Newburgh firm, Larkin Ingrassia, LLP, asserted that the school was required to notify the hospital of the youth’s dangerous propensities. Failure to do so, contended Mr. Tetenbaum, resulted in Ms. Maurer’s injuries because the hospital was unaware that precautions were needed to protect its employee. The settlement is reported to be the largest in a negligent supervision case involving a school district in the past five years in New York State, according to the New York Jury Verdict Reporter.
