Larkin Ingrassia, LLP was successful in defending our client against an application made by the ex-husband seeking to set aside the parties’ Stipulation of Settlement and to terminate his obligation to pay spousal maintenance to her.

The Court determined that there was no evidence to suggest that the Stipulation of Settlement was unfair to the ex-husband and that he had accepted other benefits of the agreement.  Additionally, the Court found that the ex-husband failed to demonstrate that the parties’ Stipulation of Settlement was the product of fraud, duress, or overreaching.

The Court dismissed the ex-husband’s application and awarded to our client counsel fees for the necessity of having to defend against the ex-husband’s application.
