How do I know if a prenuptial agreement is right for me?

If you are headed for a walk down the aisle, you are likely thinking about everything under the sun. But, are you thinking about legal documents? Marriage is a big life decision and should be treated as such when it comes to legal issues. One common legal document involved in marriage is the prenuptial agreement. So, how do I know if a prenuptial agreement is right for me? We will tackle that burning question today.

When looking at a possible prenuptial agreement, the pros definitely outweigh the cons, especially since both parties will be protected by the document. It’s understandable that this is a touchy subject for some, but in reality, it protects both parties involved from the nastiness of divorce.

One of the biggest benefits of a prenuptial agreement that can help you make a decision is that it documents what each spouse’s separate property is. The agreement will make sure that all separate property is listed as such. The agreement will also support the estate plan you create with your spouse and prevent a court from intervening when it comes time to divide property.

As you prepare for the wedding you and your spouse need to take a long, hard look at what a prenuptial agreement can do for your marriage. You need to weigh the pros and the cons carefully and make an informed decision. This is not something that should be taken lightly, by either spouse.

If your spouse is combative about a prenuptial agreement, or nonchalant, the two of you should sit down with an experienced family law attorney to have a serious discussion. The family law attorney will be able to answer all questions and explain the process thoroughly so both parties have a better understanding before making a decision.

A prenuptial agreement is a great way to protect yourself and your future spouse should the marriage end in divorce. An experienced family law attorney can answer all of your questions surrounding prenuptial agreements in Newburgh, New York.
